1. About the Platform

Open Heaven Christian Church Online Community (“Open Heaven,” “Church,” “Platform,” “we,” “us,” or “our”) is a private Christian religious ministry platform dedicated to glorifying God the Father and the Lord Jesus Christ through prayer, worship, biblical teaching, fellowship, and spiritual encouragement.

The Platform operates as a faith-based religious ministry grounded in the Holy Bible and historic Christian doctrine. Nothing herein shall be interpreted to waive any religious freedoms or constitutional protections afforded under federal or state law.

We reserve the right to operate this Platform in accordance with our sincerely held religious beliefs.

2. Acceptance of Terms

We may remove content or terminate accounts at our sole discretion without prior notice.

6. Communication Services

Participation in audio, video, and chat services is voluntary and at your own risk.

• Public rooms carry no expectation of privacy.
• We may monitor, moderate, or remove content.
• We are not responsible for user statements.
• Service uptime is not guaranteed.

Participants must maintain modest dress and respectful conduct.

7. Recording Policy

The Platform does not automatically record sessions unless explicitly disclosed.

Any user who records:

• Must obtain lawful consent from all participants.
• Is solely responsible for compliance with privacy, recording, and intellectual property laws.
• Assumes full liability for any claims arising from recording activities.

Open Heaven is not liable for decisions made based on spiritual discussions.

9. Medical and Professional Disclaimer

All content on this Platform is for spiritual encouragement only.

We are not licensed medical professionals, therapists, psychologists, or healthcare providers.

Nothing on this Platform constitutes medical advice, mental health treatment, diagnosis, or prescription.

If you are experiencing:

• Suicidal thoughts
• Severe psychological distress

10. User Accounts

We may suspend or terminate accounts at our discretion.

Usernames aka (Nicknames) may be reclaimed or modified.

11. User-Generated Content License

You grant Open Heaven a non-exclusive, worldwide, royalty-free license to host and distribute content for Platform operation and promotion.

You represent that you have rights to submit such content.

12. Monitoring and Enforcement

We may monitor content but are not obligated to monitor all activity.

We do not guarantee removal of harmful content.

Users assume risks associated with online interactions.

13. Indemnification

You agree to defend, indemnify, and hold harmless Open Heaven, its administrators, volunteers, affiliates, and agents from all claims arising from:

• Your use of the Platform
• Violation of these Terms
• Violation of law
• Intellectual property infringement
• Defamation or misconduct
• Financial disputes initiated by you

14. Donations and Payments

Donations and optional paid features are non-refundable unless required by law.

Fraudulent chargebacks may result in account termination and legal recovery.

15. Copyright and DMCA Safe Harbor

We comply with the Digital Millennium Copyright Act (DMCA).

If you believe material infringes your copyright, submit written notice including:

• Identification of the copyrighted work
• Identification of infringing material
• Contact information
• Good faith statement
• Statement under penalty of perjury

Counter-notifications may be submitted pursuant to 17 U.S.C. §512(g).

21. Export Compliance

Users may not access the Platform in violation of U.S. export laws or sanctions.

We may restrict access from prohibited jurisdictions.

22. Arbitration Agreement

Any dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Arbitration shall occur in Arkansas.

You waive:

• The right to trial by jury
• The right to participate in class actions

Claims must be brought individually.

Small claims court actions are permitted where applicable.

23. Governing Law

These Terms are governed by the laws of the State of Arkansas.

24. Notices

Notices to users may be provided electronically via email or Platform notification.

Legal notices to Open Heaven must be submitted through the official Contact page unless otherwise required by law.

25. Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

26. No Waiver

Failure to enforce any provision shall not constitute waiver of rights.

27. Assignment

We may assign or transfer our rights under these Terms. Users may not assign their rights without written consent.

28. Entire Agreement

These Terms constitute the entire agreement between you and Open Heaven regarding Platform use.

29. Survival

Provisions relating to indemnification, arbitration, liability limitations, religious protections, disclaimers, and intellectual property survive termination.

30. Changes to Terms

We may modify these Terms at any time. Continued use constitutes acceptance.
